Kandi Burruss and Todd Tucker Divorce Takes a Sharp Turn as Todd Seeks Full Custody and Prenup Review

The divorce between Real Housewives of Atlanta star Kandi Burruss and producer Todd Tucker has escalated rapidly following Burruss’s November 21, 2025 filing to dissolve their marriage. After more than a decade together, Burruss cited that the separation had been “brewing for a while,” emphasizing her desire to protect her peace and prioritize her family and personal well-being moving forward.

Todd Tucker Pushes for Primary Custody

What initially appeared to be an amicable split shifted dramatically when Tucker submitted his response on November 26. In his court filings, Tucker requested primary physical custody of their two young children, Ace and Blaze. He claimed the children already spend the majority of their time living with him in Georgia and argued that Burruss’s extensive out-of-state work commitments make him the more stable day-to-day parent.

Tucker’s filing also seeks joint legal custody, but he is requesting final decision-making authority in instances where the two cannot agree. Despite the strong legal language, Tucker described Burruss as a loving and capable mother, adding that he hopes the two can ultimately resolve matters cooperatively.

Questions Raised About the Prenuptial Agreement

Along with custody demands, Tucker also signaled his intent to challenge the validity of the couple’s prenuptial agreement. According to his filing, the agreement was presented to him immediately before the wedding, leaving him without adequate time for review and without independent legal counsel. His legal team argues that this raises concerns about whether the document was signed under pressure and whether it should be enforceable.

If the court ultimately decides the prenup is invalid, Tucker plans to pursue an equitable division of marital assets and may also seek alimony. This step marks one of the most significant shifts in what had previously been characterized publicly as a mutual and respectful separation.

A Potential Legal Battle Ahead

Though both parties have indicated a willingness to negotiate in good faith, the filings suggest that the divorce may become more contentious than originally anticipated. With custody, finances, and decision-making authority all at stake, the proceedings are poised to intensify in the coming months.

Should the court invalidate the prenup or award primary custody to either party, the outcome will have a major impact on the next chapter of both Burruss’s and Tucker’s lives. For now, both remain publicly committed to co-parenting and maintaining stability for their children while navigating an increasingly complex legal process.
